  • Advanced Healthcare Directives / Durable Power of Attorney

    The advance directive, also known as a living will, is the official California form that permits you to state your wishes for healthcare and name a trusted person who will work with doctors and other healthcare providers on your behalf.  If you like, you can also use this form to name the doctor you want to supervise your care if possible, to state your wishes about organ donation after your death and body disposition and other final arrangements you require. 

    The durable power of attorney for finances is the official California form that allows you to appoint the person of your choice to manage your finances for you if someday you can no longer do so yourself.

  • Bankruptcy

    Chapter 7 bankruptcy lets you discharge most types of debts in exchange for your willingness to give up some types of property-- that is, property that isn't exempt from creditors under state law.  If you owe money on property, you will normally either have to continue payments or give up the property.

  • Conservatorship

    A conservatorship is the  procedure where an adult is apointed by the Court to oversee the personal care and/or estate of another adult considered incapable of managing alone.  The person incapable of managing alone is the conservatoree.  The person who takes over the personal care and/or  estate is the Aconservator.

  • Deeds

    The most commonly used type of deed, a Grant Deed, is a written instrument by which title to or an interest in real property is transfered from one person or legal entity to anothor.  The Quickclaim Deed is usually used to release special interests in land such as oil, mineral or gas leases rather than convey the real property itself.  An Interspousal Transfer Deed trasfers an interest in real property between spouces.  A Trust Transfer Deed is used to transfer property to a revocable trust; a short-tern trust not exceeding 12 years; a trust where the trustor or the trustor's spouce is the sole beneficiary; a change to trustee holding title; or transfer from trust to trustor or trustor's spouce where prior transfer to trust was excluded from reappraisal and for a valuable consideration.  A Deed of Trust is utuilized by a borrower to convey "bare legal" title to the subject property to a neutral party in order to secure an obligation payable to a lender.

  • Divorce or Dissolution of Marriage

    We can handle simple divorces, divorces involving division of assets, divorces involving custody, divorces involving spousal or child support, and divorces involving military and non-military pensions.

  • Estate Planning

    Estate planning is a process where by alternatives should be considered, to think through, and to set up legally effective arrangements that would meet your specific wishes if something happens to you or those you care about.  Good estate planning is more than just a simple Will.  Estate planning also typically minimizes potential taxes and fees, and sets up a contingency planning to make sure your wishes regarding heathcare treatment are followed.
  • Evictions / Unlawful Detainer

    The eviction process is very technical.  Currently it is unlawful for a typing service to type papers in an eviction unless the person is registered and bonded in the county where they perform the services. (See B&P Code  Section 6400 et seq.)

  • Guardianships

    California law requires that minors must have an adult who is responsible for them unless, for instance they are married or emancipated by a court order.  There are two ways this can be accomplished:  An informal custody arrangement where a parent appoints a caregiver by affidavit and/or provides a guardianship authorization affidavit, or a court-appointed guardian where a court makes an order appointing a guardian.

  • Last Will and Testament

    A living trust is not for everyone.  Some people might not have an estate large enough to warrant a living trust and might do well with a simple will.  If you have minor children, you can nominate a guardian for your minor children in a will.

  • Qualified Domestic Relations Order (QDRO)

    Q.D.R.O stands for Qualified Domestic Relations Order. It is a judgment or order that is made under California family law codes and 1. relates to the provision of support or property rights to an "alternate payee" 2. creates, acknowledges, or assigns to an alternate payee a right to receive benefits under the plan and 3. meets certain statutory requirements.

  • Paternity

    Parents who are not married when a child is born can sign a Voluntary Declaration of Paternity either before they leave the hospital, or after.  The Decaration of Paterenity is a legal document that, when signed by both parents, says that the man is the natural father of the child.  If it is signed at the hospital the father's name will then go on the birth certificate, and the mother does not need to go to court to prove paternity.  If they sign after the child's birth certificate has been issued, a new birth certificate can be issued with the fathers name.  After both parents sign the declaration  and it is filed with the California Department of Child Support Services it legally establishes a parent-child relationship between the father and the child.
  • Probate

    Probate is the tern generally used to describe what happens to a person's  property before he or she dies.  The primary purpose of a probate proceeding is to make sure all of the decedent's debts are paid and that the remaining property gets to the rightful owner(s).  In California, different methods are used depending on the fair market value of the assests and how title is held.
  • Small Claims

    Small claims court is a special court where disputes are resolved quickly and inexpensively.  The rules are simple and informal.  The person who sues is called the "plaintiff."  The person who is being sued is called the "defendant."  Neither party can be represented by a lawyer.  An individual can sue another individual or a business, but may not file a claim against a federal agency.  A business, in turn, can sue an individual or another business.  In order to file or defend a case in small claims court, you must be at least 18 years old and mentally competent.

  • Stepparent Adoptions

    A stepparent adoption is much easier to complete that a nonrelative adoption.  The procedure is generally the same as for any adoption, but specific steps are sometimes waived or streamlined.  For instances; waiting periods, home studies and even the adoption hearing are sometimes dispensed with in the stepparent adoption.  In all stepparent adoptions the absent parent must consent to the adoption as she or he is the other legally recognized parent of the child.  If the absent parent refuses to consent, the adoption will not be allowed unless the parental rights are terminated for somereason -- abandonment or unfitness, for example.
  • Support, Custody, Visitation, and Other Matters

    If you have filed papers with the court for a dissolution, legal separation, nullity, or paternity proceeding, and you are in need of temporary orders for child or spousal support, custody, visitation, and other matters such as payment of uninsured health care costs, or child care expense, you will need to complete papers for filing with the court so that a hearing can be obtained for temporary orders.  The orders will be effective until a judgment is obtained or until further order of the court.
